Terms of Service

Please read these terms carefully. Continued use of Neer Social means you agree to everything below.

1. Acceptance of Terms

By accessing and using Neer Social ("the Service"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using this service.

2. Eligibility

  • Age Requirement: You must be at least 18 years old to use Neer Social.
  • Account Accuracy: You agree to provide accurate, current, and complete information during registration.
  • Account Security: You are responsible for maintaining the confidentiality of your account credentials.
  • Account Recovery: If you forget your password, you may use our account recovery process to reset it via a verification code sent to your registered email address or phone number. By providing your phone number, you consent to receiving SMS messages from Neer Social for account verification and password recovery purposes. Standard messaging rates may apply.
  • Location Responsibility: You are solely responsible for managing your device's location settings and for your personal safety when choosing to share your location or meet other users.

3. User Conduct

You agree to use Neer Social responsibly and not to:

  • Post or share content that is illegal, threatening, abusive, harassing, defamatory, sexually explicit, obscene, or otherwise objectionable
  • Share, upload, or distribute content depicting minors in any inappropriate context, or any content that sexualizes or exploits minors in any way. Such violations will result in immediate permanent ban and may be reported to law enforcement
  • Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity
  • Use the Service for spam, multi-level marketing (MLM), pyramid schemes, unsolicited commercial solicitation, or any form of advertising not expressly authorized by Neer Social
  • Upload viruses or malicious code, or interfere with or disrupt the proper functioning of the Service, including events, features, or normal platform operations for other users
  • Harass, stalk, or harm other users
  • Collect or store personal information about other users without their consent
  • Use automated systems (bots) to access the Service
  • Violate any local, state, national, or international law
  • Attempt to hack, exploit, or gain unauthorized access to the Service or other user accounts
  • Manipulate or falsify location data or proximity features
  • Scrape, harvest, or bulk-collect data or content from the platform
  • Attempt to bypass account suspensions, bans, or platform safety restrictions, including by creating multiple accounts
  • Use fake photos, misleading images, or misrepresent your appearance (catfishing)
  • Send unsolicited commercial messages, promotions, or links to external services through the messaging system
  • Solicit money, financial support, donations, or gifts from other users
  • Promote, organize, or facilitate illegal offline meetups, including but not limited to drug sales, prostitution, or other unlawful activities

4. Content and Intellectual Property

4.1 Your Content

  • You retain ownership of content you post on Neer Social (photos, messages, posts, comments, stories, event listings, and profile information)
  • By posting content, you grant Neer Social a worldwide, non-exclusive, royalty-free license to use, copy, reproduce, process, adapt, moderate, and display your content for the purpose of operating, moderating, and improving the Service
  • Stories and Ephemeral Content: Stories are shown to other users for a limited time and are then removed from public view. We may retain a copy for a short period as needed to deliver the content, prevent abuse, and enforce these Terms. Stories that are reported or flagged are retained for up to one year for safety and legal compliance, as described in our Privacy Policy. The license above applies to Stories while they are live and during any retention period.
  • You are solely responsible for your content and the consequences of posting it

4.2 Neer Social's Property

  • All rights, title, and interest in Neer Social (including text, graphics, logos, icons, software) are owned by Neer Social
  • You may not reproduce, distribute, or create derivative works without explicit permission
  • You may not reverse engineer, decompile, disassemble, or attempt to extract the source code of the Service, except to the extent that such restriction is expressly prohibited by applicable law

4.3 Copyright Infringement (DMCA)

  • Neer Social respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act (DMCA)
  • If you believe your copyrighted work has been infringed on Neer Social, you may submit a DMCA takedown notice to our designated agent at support@neersocial.com
  • Users who receive a takedown notice may file a counter-notification if they believe the removal was a mistake
  • Repeat infringers will have their accounts terminated in accordance with our DMCA Policy

5. Privacy and Location Services

5.1 Location Data Collection and Use

  • Foreground Only: Neer Social uses GPS to connect nearby users, but collects location only while the app is in use (foreground). Neer does not perform background location tracking and never requests the "Always" iOS location permission.
  • Discovery Visibility: A single setting, "Show in Discovery," controls whether your profile appears in other users' Discovery List and search results, with distance computed from your approximate last-known coordinates. When it is OFF, you are hidden from the Discovery List and search. Show in Discovery persists across sign-ins, and you can change it at any time in Settings.
  • Rounded Coordinates: All coordinates written to our database are rounded to approximately 100 meters of precision (3 decimal places). We never store your precise GPS coordinates. Only the most recent rounded location is retained, and your last-known location is kept until you delete your account.
  • Last-Known Location & Discovery: While iOS location permission is granted, your approximate last-known coordinates are written each time you open the app and are used to compute the distance shown in the Discovery List whenever Show in Discovery is ON. You can remove yourself from the Discovery List at any time using the "Show in Discovery" toggle in Settings.
  • iOS Permission Auto-Detection: If you change your iOS Location setting for Neer to "Never," the app detects this and stops collecting your location, so a live distance is no longer shared. You remain in full control through your iOS Settings.
  • Consent: By enabling location services for Neer Social, you explicitly consent to the collection and processing of your rounded location data for the purpose of connecting with and discovering nearby users.
  • Control: You can disable Show in Discovery at any time through its in-app toggle, or revoke location permission entirely from your device settings.
  • Show as Nearby: When the "Show as Nearby" toggle is enabled in Settings, your profile will display as "Nearby" to other users instead of a specific distance. This only changes how your proximity is displayed — it does not affect how location data is collected or used internally.
  • Apple 5.1.2(i) Summary: Neer Social collects location only while the app is in use (foreground), gives you direct control through the Show in Discovery toggle, stores only ~100 m rounded coordinates, never performs background tracking, never requests "Always" permission, and detects and respects iOS "Never" permission.

5.2 Data Protection and Privacy

  • Privacy Policy: Our full Privacy Policy governs how we collect, use, store, and protect your personal information, including location data. Key points are summarized here, but the Privacy Policy is the controlling document
  • Data Retention: Your most recent location is retained until you delete your account. When you delete your account, all personal data, including location data, is permanently deleted
  • Other Data We Collect: Beyond location, we also collect account, profile, usage, and device and security data — including device identifiers, IP address, the approximate location (city and region) derived from your IP address, push notification tokens, and first-party usage analytics (Google Analytics for Firebase). The full list of data types and the purpose of each is described in our Privacy Policy ("Information We Collect").
  • Third-Party Sharing: Neer Social does not sell your location data or personal information to third parties. We share limited personal data with trusted service providers (such as Firebase, Twilio, and Zoho). These providers are governed by their own privacy policies
  • Data Security: We use industry-standard encryption and security measures to protect your personal and location data in transit and at rest

5.3 Your Rights

  • Deletion: You may delete your account and all associated data at any time through Settings → Personal Details → Delete Account
  • Correction: You can update or correct your personal information at any time through Personal Details
  • California Residents (CCPA / CPRA): California residents have the right to know, delete, and correct personal information we hold about them, the right to limit our use and disclosure of Sensitive Personal Information (such as approximate geolocation), and the right to non-discrimination. Neer Social does not sell personal information and does not share it for cross-context behavioral advertising. See our Privacy Policy for the full notice and how to exercise these rights.
  • EU/EEA Residents (GDPR): If you are located in the EU/EEA or UK, you have additional rights including the right to data portability, the right to restrict processing, the right to object to processing, the right to withdraw consent at any time, and the right to lodge a complaint with your local data protection supervisory authority. Data transferred outside the EU/EEA is protected by Standard Contractual Clauses. To exercise your rights, contact support@neersocial.com, and see our Privacy Policy for full detail.

5.4 Account Security Notifications

  • Login Notifications: When a sign-in from a new device or an unrecognized location is detected on your account, Neer Social will send a security alert email to the email address associated with your account. This helps you quickly detect unauthorized access
  • Security Data Used: To detect new-device or unusual sign-ins and to prevent fraud and abuse, our login-security system records a device identifier, your IP address, the approximate location (city and region) derived from that IP address, and sign-in timestamps. These details may be shown in your security-alert email. This processing is described further in our Privacy Policy.

6. Pro Features and Subscriptions

6.1 Subscription Tiers and Features

Neer Social offers two subscription tiers:

  • Basic (Free): Unlimited discovery, standard messaging, basic analytics, and interest filtering
  • Pro ($2.99/mo or $24.99/yr): Everything in Basic, plus AI recommendations, advanced analytics, profile boost, boost events, pro badge, and profile colors
  • AI Recommendations: AI and Smart Recommendations are generated from profile, interest, and activity signals (such as your interests, age, approximate location, and profile completeness). They do not read or analyze the content of your private messages.
  • Profile Views (Pro): Pro subscribers can see the name, photo, and profile information of users who viewed their profile within the last 3 hours. Viewer records are automatically deleted after 3 hours.
  • Incognito Mode (Pro): Pro subscribers may enable Incognito Mode to browse profiles without their visits being recorded or visible to the profile owner.

6.2 Subscription Terms

  • Payment Processing: All Pro subscriptions are purchased and processed exclusively through Apple's App Store using Apple In-App Purchase. Neer Social does not directly process, store, or have access to your credit card, debit card, or other payment method details. All payment processing, currency conversion, and billing are handled by Apple.
  • Billing: The Pro subscription is billed at the time of purchase through the App Store and automatically renews on its recurring billing cycle (monthly or yearly) unless canceled.
  • Cancellation: You may cancel your subscription at any time through your Apple ID subscription settings (iOS Settings → [Your Name] → Subscriptions, or apps.apple.com/account/subscriptions). Cancellation takes effect at the end of the current billing period — you will retain Pro features until then. Neer Social does not have the ability to cancel subscriptions on your behalf.
  • Refunds: All payments are processed by Apple and are subject to Apple's refund policy. To request a refund, contact Apple directly at reportaproblem.apple.com. Neer Social cannot issue refunds for App Store purchases.
  • Auto-Renewal: Subscriptions auto-renew unless canceled at least 24 hours before the end of the current billing period. Apple will charge the renewal fee to your Apple ID payment method. If a payment fails, Apple may retry billing during a grace period; your Pro features may remain active during this time at Apple's discretion.
  • Plan Changes: You may switch between monthly and yearly billing through your Apple ID subscription settings. Changes take effect at the start of your next billing period.
  • Price Changes: We will notify you in advance of any price increase. Apple will notify you and request consent before any price change takes effect. Continued use of the Service after accepting a price change constitutes agreement to the new pricing.
  • Apple's Terms: All subscriptions are subject to Apple's App Store Terms of Service and Apple Media Services Terms and Conditions in addition to these Terms.

7. Messaging and Communications

  • Message Controls: Users can control who can message them (Anyone or Friends only).
  • Friends Only Reply: If your Messaging Privacy is set to "Friends only," users who are not your friend cannot initiate a conversation with you. However, if you message a non-friend first, they will be able to reply to that conversation.
  • Blocking: You can block users to prevent them from contacting you. Blocked users cannot send you messages or view your location or profile. Previous conversations remain visible to both parties unless deleted. Blocking does not notify the other user.
  • Message Deletion: You can delete messages you've sent at any time. Deleted messages will display as "Message Deleted" for both you and the recipient and cannot be recovered.
  • Media Privacy: Media shared in messages is visible only to the sender and recipient. If media or messages are reported for violations of these Terms or our Community Guidelines, authorized moderators may access and review the reported content and relevant conversation context.
  • Report a Message: You can report an individual message or photo in a chat by pressing and holding the message and selecting "Report," in addition to reporting users (see Section 9).
  • Safety Enforcement: In addition to reported content, we may access and review messages when:
    • Investigating potential illegal activity, threats, harassment, or other safety concerns, including violations of Section 3 (User Conduct)
    • Responding to valid legal process (subpoenas, court orders)
  • Review Scope: All message review is limited to content directly related to the investigation and is conducted by authorized moderators only.
  • No General Monitoring: We do not proactively monitor, scan, or filter private messages, and our staff do not read them for advertising, analytics, or content recommendations. If you report a message, we may review that specific message and its surrounding context to investigate (see Section 9). AI and Smart Recommendations do not use the content of your private messages.

8. Account Termination

  • Your Right: You may delete your account at any time through Settings -> Personal Details -> Delete Account
  • Temporary Deletion: When you delete your account, it is temporarily deactivated for 30 days. During this period, your profile will not be visible to other users and you will not have access to the Service. You may reactivate your account by logging back in. If you do not reactivate within 30 days, your account and all associated data — including userLocations entries and last-known coordinates — will be permanently deleted, except for transaction records which are retained for tax compliance as required by law.
  • Inactive Accounts: After 25 days of inactivity you will receive an early notification. After 30 consecutive days of inactivity, your account is automatically deactivated and enters a 30‑day grace period during which you may reactivate it by logging back in. If you do not log in within that grace period, your account and all associated data will be permanently deleted (approximately 60 days after your last activity).
  • User-Generated Content: Upon permanent account deletion, all content you have created (including profile information, photos, and messages) will be permanently deleted. This includes any messages or conversations shared with other users.
  • Safety Record: To prevent banned or removed users from evading enforcement by deleting and re-creating an account, we retain a limited post-deletion record indefinitely containing your email address, phone number, full name, account creation date, deletion date, deletion reason (e.g., user-requested or inactivity), and last activity timestamp. This record is used solely to enforce existing bans, prevent fraud, and protect community safety — not for marketing, profiling, advertising, or any other purpose. See our Privacy Policy §5.1 for details and your deletion rights.
  • Subscription Notice: All Pro subscriptions are managed and billed by Apple through your Apple ID. If you have an active Pro subscription, deleting your account does not automatically cancel your subscription. You must cancel your subscription separately through your Apple account settings (Settings -> [Your Name] -> Subscriptions) to avoid future charges. For refund requests, please contact Apple directly through their App Store support. You will retain Pro features until the end of your current billing period even after account deletion.
  • We reserve the right to suspend or terminate accounts that violate these Terms, without prior notice. If your account is terminated for violations, you will not receive a refund for any unused subscription time. If you believe your account was terminated in error, you may Contact us to request a review.
  • Effect: Upon account deletion or termination, your access to the Service will cease, and all personal data will be deleted in accordance with our Privacy Policy and applicable data protection laws, except for transaction records retained for tax compliance. If you have an active Pro subscription, you will retain Pro features until the end of your current billing period.

9. Reporting, Safety & Objectionable Content

9.1 Zero Tolerance for Objectionable Content

Neer Social has zero tolerance for objectionable content and abusive behavior. We review reports of objectionable content and act within 24 hours by removing the content and ejecting or banning the user who provided it.

Objectionable content includes, but is not limited to, content that is illegal, sexually explicit, harassing, threatening, hateful, violent, or that exploits or endangers any person. See our Community Guidelines for the full list.

9.2 How to Report

  • You can report any user, event, message, story, photo, or profile.
  • To report a user: open their profile, tap the three-dot menu, and select "Report User."
  • To report an event: tap the report flag on the event.
  • To report a message: press and hold the message and tap "Report." Choose a reason (such as harassment, hate speech, or sexual content), optionally add details or evidence, and submit. A short cooldown prevents accidental duplicate reports.
  • To report a story: tap the flag icon at the top right of the story.

9.3 Content Filtering & Moderation

  • Our Moderation Method: All users must accept these Terms and our Community Guidelines — which expressly prohibit objectionable material — before creating an account or posting any content. Anyone can report any user, event, message, story, photo, or profile (see 9.2). Our moderation team reviews and acts on reports of objectionable content within 24 hours (see 9.1), including removing the content and ejecting or banning the responsible user.
  • Private Messages: As described in Section 7, private messages are not proactively scanned or filtered. If a message is reported, authorized moderators may review that specific message and its surrounding context to investigate the report.
  • Human Review on Report: When content or an account is reported, authorized moderators may review the reported content and related context to investigate, consistent with Section 7 and our Privacy Policy.
  • Content Removal: Violating content is removed immediately upon confirmation of a violation.

9.4 Blocking, False Reports & Appeals

  • Blocking: You can block any user at any time to prevent them from contacting you or viewing your profile.
  • False Reports: Submitting false, misleading, or malicious reports may result in a warning, temporary suspension, or permanent termination of your account. Repeatedly abusing the reporting system to harass or target other users will be treated as a violation of these Terms.
  • Appeals: If your account has been suspended or banned and you believe this was done in error, you may submit an appeal by visiting our Contact page or emailing support@neersocial.com. Please include your account username and a description of why you believe the action should be reversed. Appeals are reviewed on a case-by-case basis.

10. Disclaimers

  • As-Is Service: Neer Social is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • User Interactions: Neer Social is a platform that connects users. We are not responsible for the conduct, content, or actions of any user, whether online or offline. You interact with other users at your own risk.
  • Availability: We do not guarantee uninterrupted, secure, or error-free service. The Service may be temporarily unavailable due to maintenance, updates, or factors beyond our control.
  • Third-Party Services: The Service may contain links to or integrations with third-party services. We are not responsible for the content, accuracy, or practices of any third-party services and do not endorse them.

11. Limitation of Liability

To the fullest extent permitted by law, Neer Social shall not be liable for:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, or use
  • Personal injury or property damage resulting from your use of the Service
  • Unauthorized access to or alteration of your content
  • Conduct of third parties on the Service

In no event shall Neer Social's total liability to you exceed the greater of (A) the amount you have paid to Neer Social in the twelve (12) months preceding the claim, or (B) one hundred dollars ($100 USD).

12. Indemnification

You agree to indemnify and hold harmless Neer Social from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another person or entity
  • Your content posted on the Service
  • Your interactions with other users, whether online or offline

13. Changes to Terms

  • We reserve the right to modify these Terms at any time.
  • We will notify users of material changes via in-app notification or email at least 30 days before they take effect.
  • You will be required to review and accept the updated Terms before continuing to use the Service. If you do not accept the updated Terms, you will not be able to use the app.

14. Governing Law and Dispute Resolution

  • Governing Law: These Terms are governed by the laws of the State of Florida, USA.
  • Disputes: Any disputes shall be resolved through binding arbitration in Florida, administered by the American Arbitration Association (AAA) in accordance with its rules. Either party may bring claims in small claims court if eligible.
  • Class Action Waiver: You agree to resolve disputes individually, not as part of a class action.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
